Negligent Individuals

If the defendant owns a home that is subject to a mortgage the lender will require the owner to maintain fire insurance coverage, which carries with it homeowners liability coverage.  If the homeowner or any resident family member negligently injures you a claim may be made against the homeowners insurer. The coverage applies to accidental injuries that occur on or off the insured premises. Excluded are accidents involving use of a motor vehicle, which will instead be covered by the defendant’s automobile policy. Neither homeowners nor automobile insurance will cover intentional acts of the defendant.
