In 2003 the Texas Legislature passed a tort reform package of laws that severely curtailed medical malpractice cases. Nevertheless, if there is strong evidence that injury or death was caused by negligent failure of the medical provider to follow the proper standard of care, and if the injury resulted in very substantial past and future medical costs and lost earning capacity, the victim may be able to pursue a case. The high cost of obtaining the necessary medical expert testimony will make it difficult for less seriously injured persons to sue, even if the claim is otherwise genuine.
